LADWP’s Statement About the Class Action Settlement Agreement for Customers Impacted by the Customer Information System Conversion
November 3, 2015
|Today, Judge Berle directed the attorneys involved in the class action litigation related to the customer billing system to make limited adjustments to the settlement agreement that will repay every single impacted customer 100 cents for every dollar overcharged. The parties will return to court at a new hearing date of December 21, 2015.
The proposed settlement is a result of a mediation conducted by a highly respected retired federal judge and allows any customer disputing the refund amount to appeal to an independent party who will make the final determination. If approved, it will make good on a commitment LADWP made to our customers to review every account and make whole any customer who was overcharged regardless of how small the error. Customers affected by the class action lawsuit and billing programming will be reviewed for accuracy by an additional independent expert in the billing system utilized by LADWP. The proposed settlement also includes benchmarks and key performance indicators that we fully intend to meet, and the independent monitor will report to the court about our progress quarterly.
Although the settlement is delayed, LADWP looks forward to bringing this matter to a full and complete resolution.
